A ROUPA NOVA DO IMPERADOR E O MITO CONTEMPORÂNEO DO ESTADO DEMOCRÁTICO DE DIREITO

O Estado Democrático de Direito é entendido como o mais recente modelo de afirmação de direitos humanos. Representa, segundo grande parte dos discursos jurídicos contemporâneos, o maior progresso em termos de direitos e garantias fundamentais, a última encarnação na conquista dos direitos humanos historicamente postos, ou, em outros termos, a nova roupagem do imperador, em uma visão progressista ou evolucionista do Estado. Mas, em especial, como se cristalizou a supremacia conceitual do poder, enquanto uma figura emanante do mito do poder do povo, sob o pálio do Estado de Direito? Este artigo objetiva explicitar esse paradigma jurídico, na perspectiva desconstrutivista de Jacques Derrida, de forma a (des)construir o mito do Constitucionalismo e da Democracia. Igualmente, visa explicitar conceitos importantes na obra do autor, identificar os suplementos jurídicos já utilizados em cada momento histórico, apontar a roupagem dos estados e refletir sobre a criação de alegorias no enfrentamento dos problemas sociais. Como resultado, observa-se que ambos os conceitos são suplementos de sentidos, que funcionam como dissimuladores das aporias jurídicas, como tantos outros que já estiveram em tela na história da humanidade.Downloads
