Resumo: Análise da concepção jurídica de José de Alencar sobre o direito de propriedade, em suas relações com os conceitos de civilização e modernidade, a partir de uma perspectiva católica, levando-o à crítica do Code Civil e da recepção do direito romano. Esse ponto de vista o aproxima ao catolicismo social.

Abstract: Analysis of José de Alencar’s legal conception of property rights, in its relations with the concepts of civilization and modernity, from a catholic perspective, leading him to criticize the Code Civil and the reception of Roman law.
