Resumo

A presente pesquisa discute o espaço do direito na teoria da justiça de Axel Honneth. Para tanto, o texto está dividido em três seções, sendo a primeira a análise do direito enquanto padrão de reconhecimento intersubjetivo, ao lado do amor e da solidariedade. A segunda seção trata a consolidação da teoria da justiça honnethina e a forma pela qual a justiça é pensada no centro da teoria do reconhecimento social. A terceira e última sessão aborda o lugar do direito na teoria da justiça. Considerando a tese de uma justiça descentralizada e relacional, Honneth constroi uma teoria da justiça sem a presença do direito enquanto sistema jurídico.

Abstract

The present research discusses the space of law in Axel Honneth's theory of justice. For this, the text is divided into three sections, the first being the analysis of law as a pattern of intersubjective recognition, alongside love and solidarity. The second section deals with the consolidation of the theory of justice and the manner in which justice is thought at the center of the theory of social recognition. The third and final session addresses the place of law in the theory of justice. Considering the thesis of decentralized and relational justice, Honneth builds a theory of justice without the presence of law as a legal system.
