Antônio Moreira Maués e o desenho constitucional da desigualdade

Abstract

This paper is a review of the book "The constitutional design of inequality", by Antônio Moreira Maués. The text is divided into three sections. The first is intended for a general contextualization of the work. The second aims to present the arguments of Antônio Moreira Maués. The third presents critical considerations (i) regarding the author's reading of the Brazilian political transition from the civil-military dictatorship to the democratic regime established by the 1988 Constitution and the corresponding interpretative dispute between the national political forces about this constitutional text; (ii) regarding the inequality-democracy relationship used as an interpretative key to understand the stability of the democratic regime in post-1988 Brazil; and (iii) regarding the absence of a more accurate reflection on the element that would bring together favorable and contrary to norms of compromising and socioeconomic content of the 1988 Constitution to help themselves to the mechanisms of reform of the Constitution as a strategy for making politics.
