In the Brazilian cooperative federalism, the President of the Republic has the duty to coordinate public health policies. However, during the covid-19 pandemics, the then-President Jair Bolsonaro refrained from the task of coordinating and even attempted to undermine the state policies designed by the opposing governors. Given the absence of federal coordination, it is relevant to investigate the behavior of the judiciary in the resolution of federative conflicts. In this paper, we mapped how 15 state courts responded to federative conflicts regarding the public health policies designed to face covid-19 pandemics. The data shows that, no matter how aligned the states were to Bolsonaro’s government, the state courts behaved with uniformity, usually favoring restrictive policies.
