Resumo
O objetivo do estudo é situar o tema da educação na reflexão sobre as heranças jurídicas do Antigo Regime e da Revolução francesa na primeira metade do século XIX. Antes da educação ser encarada como uma questão social e de interesse principal do Estado, a matéria é tratada como pertencente ao âmbito doméstico e vinculada ao pátrio poder. Pretende-se entender como o Código Napoleão regulou a relação entre pais e filhos, distribuindo direitos e deveres entre eles, e também verificar a atitude da doutrina e dos tribunais no tocante à educação dos filhos.

Abstract
This study aims to place the education topics in reflection about the legal inheritance of the Ancient Regime and French Revolution in the first half of the nineteenth century. Before the education is seen as a social problem, and therefore the main State’s interest, the subject is treated as an element belonging to the domestic sphere and linked to parental authority. It is intended to understand how the Napoleonic Code regulated the relationship between parents and children, distributing rights and responsibilities between them, and also check the attitude of the courts and doctrine regarding the education of children.
