Resumo
O processo de urbanização brasileiro, feito de forma excludente, forçou populações carentes a ocupar áreas irregulares, destinadas, hoje, a preservação permanente do meio ambiente. Este trabalho tem como intento analisar a possibilidade de regularização fundiária diante do conflito entre os direitos fundamentais à moradia e ao meio ambiente ecologicamente equilibrado.

Abstract
The brazilian urbanization process, proceeded in a exclusionary way, forced the poor populations to occupy irregular areas, considered, today, of permanent environmental protection. This essay has as its purpose to analyze the possibility of urban land regularization considering the conflict between the fundamental rights of housing and of an ecologically balanced environment.
