Resumo

O artigo analisa o pensamento constitucional da intelectualidade jurídica brasileira e busca compreender se este imaginário é autêntico ou apenas uma imitação de ideias importadas de países usualmente considerados mais avançados, localizados no Atlântico Norte. Por meio do método dialético e de análise de conteúdo das obras de direito constitucional mais utilizadas pelos principais cursos jurídicos do país, a pesquisa busca entender, a partir destas fontes primárias, a situação do pensamento constitucional dominante na intelectualidade jurídica brasileira. Com o marco teórico das ciências sociais e da ciência política quanto ao estudo do pensamento nacional, o trabalho aponta, em conclusão, para a sintonia entre o imaginário constitucional brasileiro e o pensamento colonial que predomina no país.

Abstract

The article analyzes the constitutional thinking of Brazilian intellectuals, and seeks to understand whether this juridical imaginary realm is authentic or just an imitation of ideas imported from countries usually considered more advanced, located in the North Atlantic. By means of the dialectical method and the content analysis of the constitutional law books more used by the main legal courses of the country, the research seeks to understand, from these primary sources, the situation of the dominant thought in the Brazilian constitutional intellectuality. With the theoretical framework of social and political sciences concerning the study of the national thinking, the paper points, in conclusion, to the harmony between the Brazilian constitutional imaginary and the colonial thought that predominates in the country.
