Resumo
O artigo apresenta conceitos e teses da obra da filósofa Judith Butler que consideramos especialmente relevantes para o pensamento jurídico que busque analisar projetos emancipatórios, em especial os que lidam com feminismos, gêneros e sexualidades. A primeira parte apresenta a crítica Butleriana à categoria de “mulher” como o sujeito do feminismo e da consequências para a representatividade dos movimentos feministas. A segunda parte trata das categorias de sexo e gênero, seus papéis na construção e naturalização de diferenciações binárias e de hierarquias. A terceira sessão discute sexualidade, heteronormatividade e o conceito de atos performativos. O quarto ponto aborda tanto o conceito aberto de agente proposto por Butler quanto a crítica ao seu pensamento que consideramos mais forte, apresentada por Seyla Benhabib.

Abstract
This paper presents elements of the work of philosopher Judith Butler that are especially relevant to legal thinking about feminisms, gender, sexuality, and emancipatory projects. The first section introduces Butler's critique of a category of "women" as well as its consequences for feminist representation. The second part deals with the concepts of sex and gender, and their role in the construction and naturalization of binary distinctions and hierarchies. Then, we discuss sexuality, heteronormativity, and performative acts. Finally, we present Butler's proposal of an alternative, the open concept of agent, as well as its most powerful critique, presented by Seyla Benhabib.
