Abstract
The history of the XX and XXI centuries shows that the return of the law and the state, associated with the recognition and protection of human rights, represents a qualitative change in legal and political systems. The rights are neither a reflection of past historical reproduction cycles nor the deduction of the human rights of political constitutions. They are a specific type of discourse with practical and social function.
Keywords: Human Rights; Social Sciences; Judiciary; Ideology; Speech.
