Resumo
Publicado pela primeira vez no ano de 2011, Direito e violência (Recht und Gewalt), de Christoph Menke, é uma das mais significativas contribuições à filosofia contemporânea do direito. Ao diagnosticar uma espécie de violência “coroada” pelo destino no seio do direito, Menke propõe uma crítica capaz de romper com seu ciclo de infinita repetição. O artigo analisa seus principais argumentos ao longo do livro, e os contextualiza em relação ao panorama mais geral do pensamento de Menke.

Abstract
First published in 2011, Christoph Menke’s Law and Violence (Recht und Gewalt) is one of the most significant contributions to contemporary philosophy of law. By diagnosing a sort of violence “crowned by fate” in law, Menke pledges for a critique capable of breaking through this cycle of infinite repetition. The article analyses his main claims throughout the book and contextualizes them with the broader landscape of Menke’s own thought.
