Resumo

Este artigo tem por objetivo analisar o Estado, a partir do complexo jurídico, e o Direito a partir da teoria social marxista, com especial enfoque na teoria marxiana, compreendendo a luta de classes como elemento de essência da superestrutura social e situando a luta dos trabalhadores como mediação com esta esfera político-jurídica para a conquista de direitos.

Abstract

This article aims to analyze the state from the juridical complex, and the Law, from a Marxist social theory point of view, with a special emphasis on Marxian theory, comprising the class struggle as a core element of social superstructure and placing the struggle of the proletariat as a mediation with this political and juridical sphere to the achievement of rights.
