Resumo
O presente artigo versa sobre a crítica que Hart faz à doutrina clássica do direito natural. Para tanto, o artigo articula quatro momentos: no primeiro, tem-se a apresentação da teoria do direito de Hart, como descrita em The Concept of Law; na sequência, expõe-se a doutrina clássica do direito natural, destacando as figuras de Cícero e de Tomás de Aquino; discute-se, em terceiro lugar, a crítica de Hart ao direito natural propriamente, pondo em relevo duas noções: a de teleologia humana e a da validade de leis injustas; por fim, no quarto momento, argumenta-se especificamente sobre a relação entre direito e moral, apontando, notadamente, para o conteúdo mínimo do direito natural.

Abstract
This article deals with the critique Hart makes of doctrine of natural law. To this end, the article puts forward four moments: first is the presentation of Hart’s Theory of Law, as described in The Concept of Law; following the classical doctrine of natural law is presented, highlighting the figures of Cicero and Aquinas; it is discussed, thirdly, Hart’s critique to natural law itself, while emphasizing two notions: a human teleology and the validity of unjust laws; and, finally, in fourth, it is argued specifically about the relationship between law and morality, pointing, especially, toward the minimum content of natural law.
