Abstract
This article investigates whether the judicial decision is and should be an activity of merely “law-applying” or of genuinely “law-making”. The theoretical problem of adjudication is seen from the perspective of the International Court of Justice (ICJ), a central forum of many-faceted conflicts in international law. The article tries to escape the rigidness of a “logic of either or” (either creation or mechanical application) and to see the nuances between both extremes. Judges neither create nor apply in the sense these concepts are usually used.

Resumo
O presente artigo analisa se as decisões judiciais são atividades que apenas aplicam ou criam o direito. A questão teórica sobre adjudicação é vista a partir da perspectiva do Tribunal Internacional de Justiça, fórum responsável por decidir vários conflitos de direito internacional. O artigo tentou escapar da rigidez de uma lógica binária (ou criação ou aplicação mecânica do direito) e ver as nuances entre os dois extremos. Juízes nem criam nem aplicam o direito no sentido em que estes conceitos são normalmente utilizados.
