This article discusses the binary gender system adopted by the General Regime of Social Security when granting certain benefits. It intends to analyze the procedures applicable to insured transgender people and to approach, through the hypothetico-deductive method and bibliographical research, the legislative omission and the judicialization of rights, seeking possible solutions to be adopted by the regime.
