This paper investigates the challenges that indigenous communities in Brazil face to guarantee access to justice, based on a case study, in which the performance of the Public Defender's Office (DPU) in the case of the Xukuru People v. Brazil in the Inter-American Court of Human Rights is analyzed. It is argued that the art. 25 of the American Convention on Human Rights demands legal assistance with multidimensional characteristics, which includes the legislative sphere and the control of the implementation of public policies.
