Resumo

O mecanismo próprio de funcionamento da ideologia é, segundo Louis Althusser, a interpelação do indivíduo como sujeito. A forma sujeito de direito, objeto da crítica de Evgeni Pachukanis, é constitutiva, na sociedade burguesa, dessa subjetividade engendrada pela interpelação. A aproximação entre Pachukanis e Althusser pode, assim, lançar alguma luz sobre o funcionamento da ideologia jurídica.

Abstract

The interpellation of individuals as subjects is, according to Louis Althusser, the proper mechanism of ideology. The legal subject, target of Evgeni Pashukanis’ criticism, is constitutive, in bourgeois society, of the subjectivity engendered by the interpellation. Thus, the rapprochement between Pashukanis and Althusser would make possible to understand a little further about legal ideology.
