Os efeitos das mudanças efetivadas pela Lei 14.879/24 na cláusula de eleição de foro: considerações sobre suas razões e adequada aplicação

The recent amendment to the forum selection clause, introduced by Law 14.879/24, has imposed a true restriction on the parties' freedom to choose the court to resolve disputes arising from the legal transactions. The Law, enacted under the reason of mitigating the parties' unfair behavior, was based on an attempt to restrict the filing of cases without jurisdictional ties to the courts. Although it may receive both criticism and praise, it is essential to determine the appropriate moment for its application. The retroactive application of the law to cases already filed is unfeasible, but its immediate enforcement to cases not yet filed is legally and by case law supported. However, due to the relationship between substantive law and the procedural rule represented by the forum selection clause, it is understood that the new rule should only apply to contracts entered into after its enactment, when the parties are already aware of the new legal provisions regarding forum restrictions.
