Abstract

The State must improve it self to deal with the heterogeneity coming from a society that is increasingly complex and plural. And, regarding the process, the same must occur. In this sense, the amicus curiae is characterized as an element that opens up the debates, previously limited only to the parties, and brings to the judge points of view and information about the controversial right conferring, as it is, greater democratic legitimacy to the decision-making process and increasing the Access of various social segments to the Judiciary, all in manifest prestige to the exercise of citizenship. The institutional relevance of the amicus curiae proves to be incompatible with the purposes of any understanding conceived that takes away the right to appeal against decisions that deny its intervention. The same can be extract from article 138 of the Civil Procedure Code, which, in its turn, restricts the appeal only when faced with a decision that admits the requested intervention
