RESUMO:
Este trabalho aborda o direito à moradia enquanto direito fundamental social, discutindo suas particularidades e diferenciando-o do direito de habitação. Relaciona o conteúdo do direito à moradia e sua inserção no âmbito da política urbana. Classifica a política urbana como política econômica, submetendo também o direito à moradia aos princípios das atividades econômicas. Por fim, elenca instrumentos jurídicos que possibilitam o Estado regular o preço da terra urbanizada e a demonstra a importância desta regulação para a efetivação do direito à moradia.

ABSTRACT:
This paper addresses the right to habitat as a fundamental right social, discussing their characteristics and differentiating it from the right to housing. Lists the contents of the right to habitat and its insertion within the urban policy. Classifies urban policy as economic policy, also subjecting the right to habitat to the principles of economic activities. Finally lists, legal instruments that allow the state to regulate the price of urban land and demonstrates the importance of this regulation for the realization of the right to habitat.
