O presente artigo analisa os temas direito da concorrência, desenvolvimento e energia renovável, no contexto da União Europeia. A motivação desse estudo é verificar se a aplicação do direito da concorrência poderia ser mitigada em face da temática energia renovável na União Europeia, ou seja, se seria possível deixar de aplicá-lo em face de um bem maior, que seria a proteção do meio-ambiente. Aborda-se o desenvolvimento como um forte fundamento e uma conexão encontrada entre o direito da concorrência e a energia renovável. Para tanto, estabelece-se a definição de desenvolvimento, baseado no autor Amartya Sen, identificando se o direito da concorrência pode ser considerado uma liberdade ou não. Considera-se a energia renovável um caminho para o desenvolvimento sustentável. Nessa perspectiva, explica-se a função do direito da concorrência na União Europeia, bem como os seus objetivos. Por fim, aborda-se a possibilidade do preenchimento de condições para aplicação de exceções previstas no art. 101, 3, do TFUE, como a isenção para agentes; e no artigo 107, 3, do TFUE, como o recebimento de auxílios públicos pelo setor de energia renovável, avaliando a viabilidade dessa iniciativa.Downloads
