A ponderação entre segurança jurídica e justiça é a base do Direito. Em matérias envolvendo direito da energia, a estabilidade do marco regulatório é desafiada com frequência por demandas envolvendo direitos de grupos socialmente vulneráveis ou pela pressão de preservação do ambiente. Neste trabalho, objetiva-se analisar, ainda que sem objetivar a exaustão do tema, como a existência de válvulas de escape para demandas correlatas ao desenvolvimento da indústria da energia é imprescindível para a estabilidade da própria indústria. Como ponto central, usa-se o caso Kiobel vs. Royal Dutch Shell, derivado da exploração de hidrocarbonetos na província nigeriana de Ogoniland.Downloads
