Resumo: O presente artigo visa discutir questões afeitas à reparação e quantificação do dano sob a égide das mudanças inseridas no Código Civil pelo legislador de 2002 com especial ênfase nas disposições apostas ao artigo 944, parágrafo único, do antecitado diploma legal. O estudo pretende demonstrar como a chamada indenização equitativa é capaz de adequar a reparação dos danos à realidade social afastando a institucionalização de injustiças decorrente do princípio da ampla reparação.

Abstract: The current article aims to discuss the questions regarding the compensation and quantification of the damage under the auspices of the changes inserted to the Civil Code of 2002 with an special emphasis on provisions attached to the article 944 sole paragraph of the aforementioned legal diploma. This study intends to demonstrate the way that the equally indemnity is able to adjust the damage compensation to the social reality  and also move away the intitutionalization of the injustices as a result of the ample compensation principle.
