Resumo
O presente artigo busca discutir a justiciabilidade dos direitos sociais. No entender do autor essa discussão vem percorrendo os mesmos caminhos. E parece não alcançar ainda uma resposta unívoca, final. O artigo procura mostrar que a razão pela qual esta discussão parece não ter solução se deve ao fato de que os pressupostos sobre os quais se sustenta impedem sopesar com clareza a magnitude do que na realidade está em questão. Isto porque quando se fala dos direitos sociais e de sua justiciabilidade, deixa-se de lado (há algumas exceções) uma explicação acabada do fundamento desses direitos. Isto enseja repensar o que entendemos por direitos humanos e, óbvia consequência, o que queremos dizer com esse substantivo “direitos” e com esse adjetivo “humanos”.

Abstract
This paper discusses the justiciability of social rights. According to the author this discussion has been touring the same paths. And it seems not yet to reach an unambiguous, final answer. The article seeks to show that the reason why this thread seems to have no solution due to the fact that assumptions about which it supports prevent clearly weigh the magnitude of what in reality is concerned. This is because when one speaks of social rights and their justiciability, let aside (there are some exceptions) a completed explanation of the basis for such rights. This entails rethinking what we mean by human rights and obvious consequence, what we mean by this substantive "rights" and the adjective "human".
