Resumo

O artigo procura discutir que, diante de todos os meios que o Direito proporciona na defesa e na efetividade dos direitos humanos fundamentais, o orçamento deve ser considerado como sendo um deles, pois, visto como uma ferramenta de planejamento do Estado, pode também ser o garantidor  dos direitos da liberdade quando assegura as prestações positivas para o mínimo existencial, e de forma geral, os direitos fundamentais, que devem ser garantidos pelos serviços públicos.

Abstract

The article discusses that, in light of all the media that the law provides to the defense and to the effectiveness of fundamental human rights, the budget should be considered to be one of them, therefore, seen as a planning tool of the state, can also be guarantor of the rights of freedom while ensuring positive benefits for the existential minimum, and in general, the fundamental rights, which must be guaranteed by public services.
