O artigo aborda os principais insumos teóricos subjacentes às discussões sobre regulação dos serviços prestados através da infraestrutura da Internet. Desde de sua expansão para o uso civil, na década de noventa, a alternância entre as ideias de exceção e harmonização caracterizam uma grande parte dos debates sobre a demanda por regulação nos mercados digitais. Existe um arcabouço teórico que é capaz de informar e fundamentar as escolhas regulatórias diante desses dilemas, hoje tratados a partir de perspectivas mais restritas a conflitos de interesse setoriais de última instância. Nesse contexto, o artigo visa acrescentar a esses debates uma perspectiva sobre o contexto teórico de insuficiência dos meios regulatórios tradicionais e busca por outros meios de legitimação; sobre os desafios peculiares que as tecnologias impõem aos reguladores e sobre como eles são tratados, especificamente, no âmbito da regulação da Internet. Propõe-se, assim, uma recapitulação da literatura acadêmica que já tratou disso, que transpassa todos os esses campos em que o debate se realiza e de onde deve partir as análises sobre a matéria.Downloads
