A partir das interações estabelecidas entre o Supremo Tribunal Federal e o Conselho Nacional de Justiça, a propósito do julgamento da Ação Ordinária nº. 1.773/DF, que versa sobre o pagamento do benefício de auxílio-moradia aos juízes brasileiros, o trabalho analisa se a forma de atualização e o desenho do regime remuneratório da magistratura levaram esta política às arenas do CNJ e STF, tornando-a litigiosa. Além disso, o texto discute se o Conselho tem agido como instituição que acentua a politização do Tribunal, seja ampliando o poder dos seus Ministros, seja criando incentivos para a mistura entre os planos gerencial e jurisdicional, de modo a transferir parte da deliberação de um colegiado “decisor” que é o STF para um colegiado “cumpridor”, que é o CNJ.Downloads
