Criminalization of the poverty and the poverty of the criminalization: the approach of the restorative justice for the complexity of the conflict

El presente estudio, que se desarrolló a partir de la perspectiva de la complejidad y la interdisciplinariedad, tiene como objetivo examinar los efectos reflejos de la corrupción y la desigualdad social desde la perspectiva de la asociación de la pobreza / criminalidad en la modernidad reflexiva, dadas las injusticias que aparecen como causas que provocan delitos. El problema cuestiona la legitimidad del carácter discriminatorio y selectivo del sistema penal brasileño, que no intimida, no castiga de manera eficiente, ni reintegra, pero en vez provoca más sufrimiento entre los implicados en el conflicto. Por último, se presenta el enfoque de la justicia restaurativa, mostrando una forma más humana, participativa y cooperativa, que apunta a satisfacer las necesidades de todos los implicados, incluida la alteridad y respeto, y moviendo la respuesta esencialmente punitiva. El método utilizado en la preparación de esta investigación fue el inductivo, con las técnicas de referente, categoría, los conceptos operacionales, la investigación bibliográfica y reporte de libro.Downloads
