Abstract

The personal liability of the judge by the slowness of adjudication is a judicial issue, because it is right and a fundamental guarantee of a reasonable duration of the process. The purpose of this research is to analyze the behavior of the magistrate, they cause at endless the process solution, setting a serious violation of the constitutional principle that ensures reasonable time to decide the disputes. The research aims to foster the ability, as determined by law, the judge is held responsible for damages in cases where it contributes to the slowness of the process. To do so uses to methods:  bibliographic, exegetical-juridical and dialectical. It was found, with research, that is not performing the procedural steps the magistrate prejudice the proper conduct of proceedings, collaborating with its slowness. Thus, it is verified that the constitutional guarantees will only be effective through the expeditious procedure, culminating in a providing judicial fair, efficient and a reasonable duration of the process.
