Abstract

This article will discuss how fear plays a role in labor relations. This is an affection mobilized to prevent workers from exercising their rights during the employment relationship. I will try to demonstrate how fear is also the affection that often prevents access to the Labor Court. The paper will work with two examples. How the lack of protection against dismissal prevents the exercise of labor rights. And the way in which the technology of labor procedural law is applied to achieve the same effect: to instill in the working class the fear of filing a lawsuit and, therefore, demanding from the State the correction of damages committed in the context of an employment relationship. The approach will be permeated by the issue of race, since labor relations in Brazil are permeated by a slave-like rationality that still sees employment as a favor. What is proposed, therefore, is a reflection on how this affection circulates in relations between capital and labor, in a model of society in which working is not a choice, but a condition for survival.
