Abstract

This research aims to carry out a study on the main opportunity costs involved in administrative appeals demands and social security legal actions related to insured, especially regarding the programmable benefit of special retirement due to unhealthy conditions resulting from exposure to the harmful agent noise. Using bibliographic, descriptive, deductive, explanatory and inductive methodologies, it has the general objective of presenting, based on a theoretical basis in the Economic Analysis of Law, what these opportunity costs are to policyholders, to assist them in deciding which is the best option. to demand their economic problem. To achieve this general objective, the following specific objectives were outlined: a) define what opportunity costs are; b) list the main opportunity costs that impact the insured in the social security process; and c) considering the opportunity costs invested by the insured, bring the main variables that help the insured to define the most efficient resource for resolving social security conflicts regarding the recognition of contribution time as special due to exposure to the harmful agent noise.
