Resumo:

O presente trabalho busca tratar o papel do estudo prévio de impacto de vizinhança frente ao direito de construir empreendimentos ou atividades que causam impactos na vizinhança. O que justifica o estudo é a necessidade de uma releitura deste instrumento de política urbana frente ao valor constitucional de proteção e preservação do meio ambiente nas cidades. Nestes termos, segue o problema da pesquisa: vista a inserção do estudo prévio de impacto de vizinhança no ordenamento jurídico global, norteado pelos valores constitucionais, quais as condições reais de sua exigibilidade em face do direito de construir? Para responder essas perguntas, buscou-se um delineamento dos fundamentos e limitações do direito de construir, buscando, seja pela doutrina seja pela ratio decidendi de alguns precedentes dos tribunais superiores, compreendê-lo diante da função social da propriedade; procurou-se trazer a concepção atual de vizinhança para em seguida abordar a disciplina jurídica do estudo de impacto de vizinhança como prévio a licença ou autorização de construir certos empreendimentos ou atividades, identificando: conceito, natureza jurídica, finalidade, objeto, fundamento constitucional, fatores de investigação, conteúdo e tramitação, e por fim, exigibilidade de sua elaboração.

Abstract:

This paper seeks to address the role of the previous study of neighborhood impact against the right to build developments or activities that impact on the neighborhood. What justifies the study is the need for a review of this urban policy instrument against the constitutional value of protecting and preserving the environment in towns. Accordingly , the following research problem : view the insertion of the previous study of neighborhood impact in the global legal system , guided by the constitutional values ​​, which the actual conditions of their enforceability in light of the right to build ? To answer these questions , we sought an outline of the foundations and limitations of the right to build , seeking , whether the doctrine is the ratio decadent of some precedents of higher courts , understand it before the social function of property , sought to bring current conception of neighborhood to then address the legal discipline of the study of neighborhood impact as the previous permit or authorization to construct certain projects or activities , identifying: concept , legal nature , purpose , object , constitutional basis , research factors , content and processing , and finally enforceability of its preparation .
