Resumen
En Argentina el derecho a la Educación cuenta con una amplia protección normativa a nivel nacional e internacional. Pese a ello su goce y disfrute presenta serias dificultades. Frente a estos graves incumplimientos, muchos han sido los reclamos por vía judicial quese han realizado. Sin embargo ello no resulta suficiente. Objetivo: Con carácter exploratorio y propositivo se pretende responder a la pregunta de si la Judicialización del Derecho a la Educación, ¿Resulta suficiente a la hora de logar su efectivización?. Método: desde una perspectiva crítica y a partir de un análisis de fallos del poder judicial argentino este trabajo tendrá por finalidad indagar en la búsqueda de una posible solución al problema en mención. Resultado: Se concluye que una salida –a la fecha no experimentada- podría ser el realizar el reclamo bajo el lineamiento y paradigma del Derecho a la Ciudad. Aporte: Se abre un ámbito de reflexión y entrecruzamiento entre el Derecho a la Educación, el Acceso a la Justicia y el Derecho a la Ciudad.

Abstract
In Argentina, the right to education enjoys broad national and international normative protection. In spite of this, its enjoyment presents serious difficulties. In the face of these serious non-compliances, many legal claims have been filed. However, this is not enough. Objective: With an exploratory and propositive character, we intend to answer the question of whether the judicialization of the Right to Education is sufficient to achieve its effectiveness. Method: from a critical perspective and based on an analysis of rulings of the Argentine judiciary, the purpose of this work will be to investigate the search for a possible solution to the problem in question. Result: It is concluded that a solution - unexperienced to date - could be to make the claim under the guidelines and paradigm of the Right to the City. Contribution: It opens a space for reflection and intertwining between the Right to Education, Access to Justice and the Right to the City.
