Os bens comuns e o controle de desafetação de bens públicos / The commons and the restriction of acts of disruption of public goods
Resumo
Abstract
The present paper examines the theory of the Commons, whose access stands out when associated with the ability to enforce fundamental rights. In this direction, correlating is the analysis of public goods and their affectation (or not) to collective interest, focusing on the functions performed. Into the three goods categories developed by the Civil Code, the ‘goods for the common use of the people’ are the most related to commons, although they are not identical, since the ‘goods for common use of the people’ are still based on the proprietary rationality of the dichotomy "public property" and "private property". Nevertheless, there are areas of convergence that give rise to discussion and increase the jurisprudential repertoire. In addition to the fact that the public affectation is not, by itself, a guarantee of the allocation of the public goods to the collective interest, there is also the debate about control of public goods disruptions, turning into domanial property and allowing their alienation, often contrary to the logic of Commons. Hence, it is crucial to develop objective and solid criteria for the treatment of these goods, so that the public property regime is equally linked to its social function, aiming at promoting fundamental rights.
