Resumo

o artigo busca desenhar os contornos do ordenamento jurídico do patrimônio cultural português, abordando diversas considerações sobre o tema. Inicialmente, são feitas algumas considerações sobre a terminologia adotada. A seguir é tratada a questão da inclusão do patrimônio na,tural no conteúdo abrangido pela expressão patrimônio cultural, o que é rejeitado no ordenamento jurídico português. Todavia o conceito permanece amplo, o que exige uma certa cautela na sua compreensão de modo a evitar o fundamentalismo
e a conseqüente banalização do seu conteúdo. A seguir é abordada a diversidade do patrimônio cultural, tendo em
vista a sua evolução da noção de monumentos nacionais para a de imóveis de interesse público, e a posterior incorporação das zonas de proteção dos imóveis, os bens concelhios e os bens imateriais. Esta diversidade também se refere à sua estrutura e as perspectivas das comunidades cuja identidade cultural suportam. Em uma breve digressão no plano internacional, é observado que a tutela do patrimônio cultural só iniciou-se efetivamente a partir da criação da UNESCO, com especial ênfase para as Convenções de 1970 sobre a exportação e o tráfico ilícito de bens culturais e a de 1972 para a proteção do patrimônio mundial cultural e natural. Também é destacada a Concordata com a Santa Sé, de 2004, convenção bilateral com importante papel na disciplina jurídica patrimônio cultural português pertencente à Igreja Católica. Para finalizar, são
abordadas questões específicas do ordenamento jurídico português. A tutela constitucional do patrimônio cultural que está compreendida na constituição do indivíduo, na constituição da sociedade e na constituição do Estado. Além disso a sua proteção e valorização figura dentre as tarefas fundamentais do Estado português. No ordenamento infraconstitucional é ressaltado o papel da Lei de Bases da Política e do Regime de Protecçãoe Valorização do Património Cultural, de 2001, sendo citadas também a Lei do Patrimônio Cultural Subaquático, os diplomas orgânicos dos serviços encarregados da tutela do patrimônio cultural e o Estatuto do Mecenato. Além destes instrumentos o ordenamento jurídico português dispõe de diversos benefícios fiscais aos proprietários de bens culturais.

Abstract:

The article analyses the Portuguese cultural heritage legal system, encompassing many issues of this subject. Initially, some considerations are made about the terminology adopted. Then, the author deals with the inclusion of natural heritage in the concept of cultural heritage, which is denied in the portuguese legal system. However, the concept remains broad, which demands caution in its comprehension in order to avoid the fundamentalism and the consequent vulgarization of the concept. It also deals with the cultural heritage diversity considering the evolution of national monument notion· to public interest buildings, and the later incorporation of the buildings protection zones, the goods ''concelhios''and the immaterial goods. This diversity refers also to its structure and the community perspective, which cultural identity they support.
In a fast digression on international leveI, the author observes that cultural heritage protection just started effectively from the UNESCO creation, with special emphasis to the Conventions of 1970 against the illegal traffic of cultural goods and the Convention ofWorld Cultural and Natural Heritage protection
of 1972. Also, the article highlights the "Concordata" with the Santa Se, 2004, a bilateral Convention with an important role in the legal regime of Portuguese cultural heritage that belongs to the Catholic Church. The constitutional protection of cultural heritage is included in the individual constitution, society
constitution and State constitution. Besides, the protection and promotion of cultural heritage is one of the fundamental State responsibilities. In the infraconstitutional legal system, it emphasizes the 2001 Protection and Promotion of Cultural Heritage Regime Act, mentioning also the Underwater Cultural
Heritage Act and Mecenato Statute. The Portuguese legal system also offers many financials benefits to the owners of cultural goods.
