Resumo

O artigo tem por objetivo demonstrar a intercessão entre dois direitos fundamentais em nosso ordenamento jurídico: o Direito de Habitar e o Direito à Segurança. Incidente. Feita uma análise econômica dos direitos sob análise, igual própria demonstrar os diferentes contatos econômicos nos quais surgiram. Que se refletem no conteúdo destes direitos. Constatada a correlação entre os dois direitos no modelo econômico vigente no Estado brasileiro, o autor passa a verificar no plano material, o inter-relacionamento dos direitos concernentes à habitação e segurança no meio urbano. Para tanto, busca isolar as variáveis correspondentes ao direito de habitar o meio urbano e verificar em que proporção a negativa deste direito vulnera o direito à segurança, concluindo que o maior respeito ao direito de habitar contribui, significativamente, para uma melhor  implementação do direito à segurança. Por fim, o artigo faz uma abordagem crítica da legislação produzida no Brasil desde o fim da decada de 1970, procurando analisar a capacidade da norma em implcmentar o direito de habitar e no que a esta legislação contribui (ou prejudica) a implementação do direito à segurança. Esta análise abrange três momentos significativos da produção legislativa; a lei 6.766/ 79, com as aIterações trazidas pela Lei 9.785/99. que disciplina o parcelamento do solo urbano, a implantação e consolidação do Sistema Financeiro Habitacional, através das COHABs e posteriormente do Banco Nacional da Habitação - BNH, a Constituição de  1988 e a  Lei  l0.257/2001, o Estatuto  da Cidade.

The syntax of the right to security and the housing right (while considered as an urban right): a preliminar approach of human
rights at the urban environment

Abstract

The article's goal is to demonstrate the intersection between two human rights in our legal system: the right to housing and the right to security. First, the author makes an economic analysis of these rights, which searches to demonstrate the different contexts in which they arise. The author verifies, in the material leveI, relation of these two rights in the urban environment. For
this, he searches to isolate the variables corresponding to  housing rights in the urban environrnent verifying in which proportion denial of this right violates the right to security. Thus concludes that a higher respect to the housing right contributes to a better implementation of the right to security. Finally, the
article makes a critical approach to Brazilian statutes enacted since the end of 1970 decade, searching to analyse the capacity of a legal ruIe to implement the right to housing and how legislation contributes (or hinders) the implementation of the right to security. This analysis includes three important
moments of legislative production: Law 6,766/79, with the alterations brought by the Law 9,785/99, which disciplines the urban land disposition, the creation and consolidation of  Financial Housing System, through COHABs and later National Housing Bank - BNH, the 1988 Federal Constitution, and Law 10,257/2001 - Statute of the City.
