Resumen: El artículo examina la estrategia jurídica impulsada por el candidato presidencial Raúl Alfonsín para tramitar las violaciones a los derechos humanos cometidas en la Argentina por su última dictadura militar (1976-1983). Por un lado, se examinarán las premisas políticas de esta propuesta y sus vínculos con una determinada perspectiva sobre el pasado de violencia política en el país. Y, por otro, se analizarán sus vínculos con las luchas políticas libradas en el contexto de su elaboración, durante la transición política de la dictadura militar a la democracia. Por último, se presentará las filiaciones de esta propuesta jurídica con los modelos teóricos dominantes a escala internacional en los años ochenta del Siglo XX para pensar y juzgar los procesos de exterminio. El artículo buscará mostrar cómo la estrategia de Alfonsín de juzgar a los máximos responsables de las violaciones a los derechos humanos buscó atender al deber ético de hacer justicia ante esas violaciones, y, simultáneamente, al objetivo de preservar la democracia y asegurar los derechos humanos presentes y futuros. Este doble objetivo, se propone, constituyó el origen de los dilemas y las tensiones que enfrentó esta propuesta.

Abstract: The paper examines the legal strategy driven by presidential candidate Raúl Alfonsín to deal with violations of human rights committed in Argentina by its last military dictatorship ( 1976-1983). On the one hand, I examine the political premises of this proposal and its links with a particular perspective on the history of political violence in the country. On the other hand, I analyses its links with the political struggles waged in the context of its development during the political transition from military dictatorship to democracy. Finally, I present the legal affiliations of the strategy with the theoretical models that dominate internationally in the eighties of the twentieth century to think and judge extermination processes. The article will seek to show how the strategy Alfonsín to judge the principal perpetrators of human rights violations sought to address the ethical duty to do justice to these violations and, simultaneously, the aim of preserving democracy and ensuring human rights present and future. This dual objective, it is proposed, it was the origin of the dilemmas and tensions faced by this proposal.
