Resumo: O presente estudo apresenta a visão atual do Poder Judiciário, apontando os requisitos considerados para a aplicação da teoria da substancial performancesurgida no sistema da common law do direito inglês. Diante do levantamento jurisprudencial realizado, pudemos verificar que os julgadores vem decidindo as demandas postas à sua apreciação de acordo com taxa de inadimplência em proporção ao valor total do negócio. Conquanto não se possa afastar esse critério, o qual constitui a origem da teoria do adimplemento substancial, chegamos à conclusão de que ele não pode servir como fator determinante para a aplicação da referida teoria, impondo-se a análise conjunta de outros pressupostos, como o exercício da função do contrato, a presença da boa-fé objetiva de ambos os lados, a vedação ao enriquecimento sem causa e ao abuso de direito, bem como a necessidade de se manter as avenças realizadas.

SUBSTANTIAL PERFORMANCE AND TERMINATION OF CONTRACTS
NEED FIXING OF A UNIFIED CRITERION
Abstract: The present study provides a current overview of the juridical power, pointing to the required requisites in order to apply the performance substantial theory, which has arisen in the Common Law system of the British law. In the face of the jurisprudence survey, we could notice that judges have been deciding about the demands under their assessment judgment, according to the default rates in proportion of the business total price. While that criterion cannot be excluded, since it constitutes the beginning of the substantial performance theory, we conclude that it cannot be the determinant factor of the theory referred above, so that it is required a jointly analyzing of different assumptions, such as, the exercising of the contract function, the objective good faith from both sides, the prohibition of enrichment with no cause as well as the necessity to keep the agreements already made.
