Resumo: O presente artigo tem por finalidade pôr fim a um dos maiores tabus do Direito Administrativo Constitucional contemporâneo, qual seja, o exercício do poder e das funções públicas pela iniciativa privada. Longe de pretender esgotar o tema, este ensaio se propõe a buscar as raízes históricas que fizeram com que a delegação das funções aqui examinadas se tornasse alvo de severas críticas por parte dos defensores da soberania interna do Estado em detrimento da soberania dos cidadãos. Interessa também reiterar a necessidade de garantir que toda função estatal, seja ela desempenhada por ente público ou privado, se dê sempre em razão e em função do legítimo interesse público primário.

EXERCISE OF POWERS OF PUBLIC AUTHORITY FOR PRIVATE ENTITIES: SOME REFLECTIONS
Abstract: The present article intends to break one of the biggest taboos of the contemporary constitutional and administrative law, which consists of the exercising of power and the public functions by the private initiative. Without aiming to exhaust the topic, this essay proposes to seek the historical roots, which have made the delegation of functions, examined in this article, became the target under severe criticism by the supporters of the internal State sovereighty in detriment of the citizen sovereighty. It is also desired to highlight the need to garantee that every State function, performed even by the public or private entity, always happens in view of the legitimate interest of the primary public.
