Nas últimas décadas tem crescido o número de publicações que assinalam a intersecção entre Direito e manifestações culturais, como o Cinema. O artigo aborda o tema da representação sexualizada da vítima de estupro no filme Os Acusados, visando responder ao seguinte problema de pesquisa: qual a representação de gênero da vítima de estupro no filme Os Acusados? A hipótese que alicerçou a delimitação do tema e problema foi que a representação de gênero da vítima de estupro no referido filme é de culpabilização da vítima. Não parece incomum, dentro do contexto social e jurídico, que a mulher seja culpabilizada quando ocorre crime de ordem sexual, sendo julgada pelas suas atitudes, características e vestuário. O estudo tem como objetivo investigar a representação de gênero da vítima de estupro no filme Os Acusados. O método utilizado foi o dedutivo, através da utilização dos instrumentos de pesquisa: fontes fílmicas, bibliográficas, documentais e jurisprudenciais. Metodologicamente, delimita-se o conceito de gênero a partir do âmbito social e cultural para, sequencialmente, tratar-se da narrativa do filme, discutindo como a culpabilização pelo estupro acaba sendo atribuída à vítima, contribuindo para a construção do conceito de gênero patriarcal que se perpetua na sociedade.

Abstract

Over the past decades, there's been a raise on the publications that point out the intersection between Law and cultural manifestations, like Cinema. The article approaches the subject of the sexualized representation of the victim of rape on the movie The Accused, aiming to answer the following research problem: what's the rape victim's representation of gender on the movie The Accused? The hypothesis that consolidated the subject and the problem's delimitation was that the gender representation of the rape victim on the film pointed is the blaming of the victim. It's not unusual, inside the social and legal context, that the woman is to blame when a sexual order crime happens, being judged for their attitudes, characteristics, and clothing. The study's goal is to investigate the rape victim's representation of gender on the movie The accused. The method was the deductive, through the use of the research tools: filmic, bibliographical, documental and jurisprudential sources. For the bibliographic analysis, the concept of gender is delimited from social and cultural scopes, then, we discuss the movie narrative, discussing how the blame for the rape ends up imputed to the victim, contributing to the construction of the patriarchal gender roles in society.
