Resumo

Há quem diga hoje que a lei está em crise, e que a atividade legislativa é insuficiente e ineficaz no que diz respeito às novas demandas da sociedade. O modelo legalista liberal, que se acreditou por muito tempo ser a base essencial do Estado de Direito, não é mais um elemento de garantia da justiça social. Esse é um problema de elevado teor teórico e que tem como causa, distintos e diversos fatores muito complexos. Para solucionar esse impasse, parece necessário resgatar o clássico debate entre legalidade e legitimidade, com o fim de se tentar oferecer diagnósticos e respostas sensatas aos novos desafios sociais, éticos, políticos e jurídicos que se apresentam nas sociedades democráticas contemporâneas. A abordagem dessa questão fundamental é o que constitui a temática presente nesse livro que é na verdade uma compilação de dez trabalhos de diversos autores. Os seus distintos enfoques teóricos nas áreas de filosofia, moral, política, sociologia e direito, garantem uma abordagem plural e muito bem fundamentada. Não se trata de uma mera acumulação de trabalhos autônomos, mas sim de uma coleção que responde a uma lógica coerente e consistente, fruto do brilhante trabalho de seu editor, o professor doutor Juan Antonio Gómez Garcia. A obra é, acima de tudo, uma agradável leitura e talvez um dos mais interessantes trabalhos produzidos nos últimos anos sobre a questão da legalidade e legitimidade.

Abstract

Some say today that the law is in crisis, and that the legislative activity is insufficient and ineffective with regard to the new demands of society. The liberal legalistic model, which was believed for a long time to be the essential basis of the rule of law, is no longer an element of ensuring social justice. This is a high theoretical content problem and caused by, distinct and several very complex factors. To solve this problem, it seems necessary to rescue the classic debate between legality and legitimacy, in order to try to provide diagnostic and sensible answers to new social, ethical, political and legal challenges that arise in contemporary democratic societies. The approach to this fundamental question is the theme of this book, which is actually a compilation of ten works of various authors. Their different theoretical approaches in the large areas of philosophy, morality, politics, sociology and law, guarantee a plural and well-reasoned approach. It is not a mere accumulation of independent texts, but rather a collection that responds to a coherent and consistent logic, due to the brilliant work of its editor, Professor Dr. Juan Antonio Gómez. The book is, above all, an enjoyable read and perhaps one of the most interesting works produced in recent years on the issue of legality and legitimacy.
