O discurso jurídico dominante que sempre tratou a questão das identidades sexuais transgressoras (homossexuais, bissexuais e transexuais) como uma "ausência" encontra-se hoje na defensiva diante de uma reivindicação que adquire cada vez mais legitimidade junto à ordem jurídica. Após situar a questão no atual contexto social, valendo-se de uma abordagem sócio-jurídica, o artigo focaliza o discurso jurídico em senso estrito, isto é, os determinantes internos da razão jurídica. Serão analisados os aspectos constitucionais, cíveis e previdenciários, destacando os marcos da controvérsia jurídica em torno da possibilidade de inserção dos direitos de gays, lésbicas, bissexuais e transexuais na atual ordem jurídica brasileira. Veremos que, não obstante a resistência dos juristas conservadores, há uma crescente recepção dos pontos de vista dessas identidades da sexualidade no Direito. Para terminar, serão traçadas algumas linhas de perspectiva para a questão dos direitos das identidades sexuais transgressoras.

Abstract
The dominant legal discourse that always dealt the issue of transgressive sexual identities (homosexuals, bisexuals and transexuals) as an "absence" is currently defensive in face of a claim that each day acquires more legitimacy in the legal system. After putting the issue within its current social context, employing a socio-legal approach, the article focuses the legal discourse in its strict sense, that is, the internal determinants of the legal reason. The author analyzes constitucional, civil and social security matters, highlighting the marks of the legal controversy about the possibility of inscribing the rights of gays, lesbians, bisexuals and transexuals into the Brazilian legal order. We can see that, notwithstanding the resistence of conservative jurists, there is a growing reception of the viewpoints of these sexuality identities in Law. To finish, some lines of perspective to the issue of transgressive sexual identities’ rights are drawn.
