Resumo:
Resulta questionável apresentar, como foi habitual, a relação entre direito positivo e direito natural como se se tratassem de dois ordenamentos distintos. O positivismo jurídico teve de assumir a mudança de cenário provocada pelos ordenamentos constitucionais do pós-guerra; relaxando sua drástica separação entre direito e moral, deu lugar a um chamado positivismo "inclusivo". Também a partir do jusnaturalismo ter-se-ia de assumir a famosa afirmação positivista segundo a qual só é direito o direito positivo, dando lugar também a uma versão "inclusiva”. As leis contra natura não deixam de serem leis, embora desnaturalizadas; o que, além de imorais, as faz sobretudo juridicamente deficientes. O jusnaturalismo não há de oferecer uma legalidade alternativa, mas sim questionar o legalismo como caricatura do jurídico. No fundo, a fronteira entre positivismo e jusnaturalismo estribará em se os positivistas continuam subscrevendo um não-cognitivismo ético, incompatível com os ordenamentos constitucionais, e em que os jusnaturalistas continuarão afirmando a existência de uma realidade jurídica objetiva como a única capaz de oferecer fundamento a seus direitos fundamentais. A via de aproximação exige uma reabilitação da filosofia prática, que questiona um exaustivo normativismo jurídico, para reconhecer o obrigatório protagonismo dos princípios. Não servirá de solução uma "dúvida demiúrgica", empenhada em criar fundamentos meramente procedimentais.

Abstract
It sounds questionable to present, as usual, the relation between positive law and natural law as if they belonged to different realms. Legal positivism had to acknowledge the changing scenario brought about by the post-war constitutional framing, which blurred the stringent limits between law and morals, and gave room to a so-called "inclusive" positivism. From jusnaturalism as well, the famous positivistic statement, according to which only positive law is law, would inevitably arise, giving room to an "inclusive" version. Laws contra natura would not cease to be laws, even though denaturalised (what, besides immoral, renders them juridically defective). Jusnaturalism is not to offer an alternative legality, but questions legalism as a parody of the legal. Actually, the borderline between positivism and jusnaturalism will depend upon the former's refusal of an ethic cognitivism, incompatible with today's constitutional framing; and the latter's claim to an objective juridical reality as the only capable of laying the foundations of its fundamental rights. The path to an approach demands a rehabilitation of practical philosophy, which questions an exhaustive juridical normativism to recognise the pre-eminent place that belongs to principIes. And, as a solution, a "demiurgical doubt" striving to devise merely procedural foundations will not suffice.
