Resumo

Análise da interação entre os estudos sobre a metodologia jurídica e o dever de motivar, previsto no art. 93, IX, da Constituição. Para facilitar a compreensão do que são esses estudos, descrevem-se exemplificativamente três modelos de fundamentação das decisões judiciais que eles propõem. Em seguida, afirma-se que tais modelos podem contribuir para estabelecer o conteúdo do dever de motivar e que a doutrina especializada, diferentemente dos manuais, tem valorizado as investigações metodológicas. Nada obstante, o Supremo Tribunal Federal, ao interpretar o art. 93, IX, da CR, somente tem sido rigoroso com a motivação de decisões que restringem direitos fundamentais. A metodologia adotada foi a pesquisa bibliográfica e jurisprudencial.

Abstract

This article analyzes the connection between the studies of judicial methodology and the duty to motivate, as prescribed by the Brazilian Constitution. It is proposed that methodological studies, such as those conducted by Perelman or Alexy, may contribute to establish the content of the duty to give judicial reasons. Such a contribution is generally esteemed by the specialized doctrine. Nonetheless, the Brazilian Supreme Court is strict only when it reviews the reasoning of lower courts' decisions that restrict human rights. Even though it is sensible to privilege such decisions, it may be too much not to care about the judicial reasoning of more ordinary judgements.
