Resumo
Historicamente, sempre se entendeu que o Direito Adminstrativo surgira como garantia do primado da lei e dos direitos individuais sobre a força; corifeu da Revolução Francesa contra o absolutismo do Antigo Regime. O presente artigo busca justamente desmistificar esta explicação – tão bela quanto irreal – ao considerar as categorias básicas do Direito Administrativo como instrumentos legitimadores dos donos do poder. Entre as premissas mais decantadas pela doutrina está a da supremacia do interesse público, que jamais poderia ser – como é – erigida em princípio, que é norma aberta. Nesse sentido, o real sentido do interesse público deve ser obtido através do procedimento da proporcionalidade, pela lógica do princípio constitucional da igualdade, que sem eliminar o primeiro, nega a sua supremacia sobre os interesses individuais.

Abstract
It has been historically understood that Administrative Law came up as the expression of the primacy of law and of individual rights over the force; warrior of the French Revolution against the Old Regime. This work tries to dismiss this explanation – as beautiful as unreal – by the consideration of the basic categories of Administrative Law as Iegitimation tools of the power holders. Among the most celebrated doctrinal premises one finds the supremacy of Public Interest, which never could be heightened to a principIe, since it is an open norm. The real meaning of Public Interest must be obtained by the procedure of proportionality, by the logic of the constitutional principIe of equality, which denies the supremacy principIe over individual interests, without eliminating the former.
