Foco e Escopo

A Quaestio Iuris (QI) é uma publicação trimestral da Faculdade de Direito da Universidade do Estado do Rio de Janeiro – UERJ e destina-se a divulgar trabalhos de cunho acadêmico que versem sobre temas de Direito em suas diferentes áreas, como a teoria do direito, a filosofia do direito, a sociologia do direito, o ensino do direito, direitos humanos  e a história do direito. Serão aceitos trabalhos que promovam o debate e a circulação de novidades teóricas, doutrinárias, jurisprudenciais e legislativas no âmbito do Direito, com ênfase no enfoque multidisciplinar dos institutos jurídicos. Além da tradicional seção de artigos originais, a Revista Quaestio Iuris publica ensaios, monografias e resenhas de livros recentemente publicados e de notória contribuição ao estudo do direito. Artigos são aceitos em português, francês, espanhol e inglês.

A Revista Quaestio Iuris adota os princípios contidos nos Códigos de Ética do Committeeon Publication Ethics (COPE) (http://www.publicationethics.org/) e do Conselho Nacional de Desenvolvimento Científico e Tecnológico (http://www.cnpq.br/web/guest/diretrizes).

The Quaestio Iuris (QI) it’s aquarterly periodical of professors of the Faculty of Law from University of State of de Janeiro- UERJ and is intended to promote academic nature papers that look over law issues in their different areas, such as work theorythe philosophy of law, the sociology of law, human rights, and the history of lawt will be accepted papers that promote the debate and the circulation of theoretical novelties, doctrinal, jurisprudential and legislative under the lawwith emphasis in multidisciplinary approach of legal institutions. In addition to the traditional section of the original articlesQuaestio Iuris Journal publish esasays, monographs and reviews of recently published books and of notorious contribution to the study of law. Papers will be accepted in portuguese, french, spanish or english.

Quaestio Iuris Journal adopts the principles contained in the Code of Ethics from the Committee on Publication Ethics (COPE) (http://www.publicationethics.org/) and in the Conselho Nacional de Desenvolvimento Científico e Tecnológico (http://www.cnpq.br/web/guest/diretrizes).

Processo de Avaliação pelos Pares

A submissão online do trabalho no sistema da Revista Quaestio Iuris, sediada na plataforma SEER (Ibict), é o primeiro passo à avaliação dos trabalhos. Para acompanhamento do processo de avaliação, pelo autor, é obrigatório seu registro na página da revista, cujo acesso se dá mediante login e senha personalizados. Submetido o trabalho conforme as diretrizes para autores. Os artigos são, então, distribuídos aos avaliadores ad hoc, mínimo de 3 selecionados, para que, em um prazo de 3 semanas, possam preencher o formulário eletrônico disponível na página da revista e, ao final, envia-lo, ao editor, juntamente ao parecer. A escolha dos avaliadores ocorre segundo as áreas de interesse dos mesmos para avaliação. Para cada avaliador escolhido é enviado um e-mail convite, com o link para direcionamento ao trabalho. Cabe ressaltar que é vedada qualquer identificação nos trabalhos submetidos à revista Quaestio Iuris, excetuando-se os autores convidados articulistas e de seções especiais. O avaliador só terá acesso ao artigo a ser examinado, bem como ao formulário de avaliação a partir do momento em que aceitar o convite para exercer a atividade, dentro do prazo estipulado. O formulário eletrônico é pautado por questões de ordem objetiva. Inserido na política de fomento à realização de pesquisa de qualidade e condições éticas à publicação de trabalhos adotada pela Revista Quaestio Iuris, orienta-se os avaliadores a proceder conforme as seguintes instruções: "Os trabalhos submetidos à Revista Quaestio Iuris devem, impreterivelmente, obedecer às condições éticas de publicação divulgadas em nossas Políticas de Sessões. As análises compreenderão interpretação de quesitos objetivos. Cabe aos pareceristas criticar, exclusivamente, os trabalhos, sendo vedadas considerações pessoais quanto aos autores, ou posicionamentos parciais que restrinjam a produção de conhecimento de matriz multidisciplinar, a liberdade de expressão e autonomia do pesquisado”.

Todos os itens do formulário são de preenchimento obrigatório. Em cada item do formulário é possível optar entre 5 (cinco) níveis distintos de satisfação quanto aos critérios elencados. Deve haver coerência entre as manifestações frente aos tópicos e o parecer dirigido aos autores. Cada avaliador terá, como prazo improrrogável, 20 dias úteis para enviar o parecer, a contar da data de envio do trabalho ao avaliador. Em caso de impossibilidade na execução do parecer, a Revista QI deverá ser informada no prazo de 48 horas a contar do recebimento do trabalho.

O resultado final do exame será enviado aos autores, com as justificativas que apontem a aprovação sem restrições, aprovação condicionada ou a reprovação da obra à publicação. Agradecemos a disponibilidade em participar do corpo de pareceristas da Revista Quaestio Iuris. Todos os esclarecimentos necessários podem ser solicitados através do e-mail: revistaquaestiojuris@gmail.com". A decisão editorial é pautada com base na maioria das manifestações dos autores, variando entre "aprovado sob restrições", "aprovado sem restrições", "reprovado". Registrada a decisão editorial, o editor envia ao autor, por e-mail, tanto o conteúdo da decisão quanto as avaliações que a ensejaram. Em todas as hipóteses de decisão o autor recebe os pareceres que lhes motivaram. Não há identificação dos pareceristas e/ou algum tipo de contato entre os mesmos. Em caso de aprovação sem restrições ou sob condições, cabe ao autor reenviar seu trabalho no prazo de 15 dias úteis, com as retificações apontadas, se for o caso, sendo-lhe expresso o direito de discordar da avaliação, justificando seu ponto de vista e a construção de sua obra.

Inserted in the development policy to the achievement of quality researchand ethical conditions for the publication of papers adopted by the QuaestioIurisJournal, itsguided to the evaluators to proceed according to the following instructions: "The papers submitedto the QuaestioIurisJournalshould, without fail, obey to the ethical conditions of publication disclosed in our Sessions policies. The analysis will include interpretation of objectives questions. All items on the form are required. In each item from the form is possible to choose among 5 (five) different levels of satisfaction with the criteria listed. The final result of the examination will be sent to the authors, with the justification that point approved without restrictions, conditional approval or thedisapproval of the work for publication. The editorial decision is guided based on the majority of the manifestations of the authors, ranging from“approved,under restrictions", "approved, without restrictions", "disapproved". Registered the editorial decision, the editor send to the author, by e-mail, as the content of the decision as the reviews that gave rise. In all the hypotheses the decision the author receives the opinions that motivated them. There is no identification of the referees and / or some kind of contact between them. In case of approval without restrictions or under conditions, it`s up to the authorresubmit their work within 15 working days, with the indicated corrections, if appropriate, being expressed the right to disagree with the evaluation, justifying your point of view and the construction your work.

Periodicidade

A Quaestio Iuris (QI) publica edições trimestralmente, nos meses de fevereiro, maio, agosto e novembro. Os originais serão recebidos em fluxo contínuo, através da página da Revista QI, desde que atendidas as especificações elencadas nas diretrizes para autores.

The Quaestio Iuris Journal publishes thirdly editions in February, May, August and November. The original documents will be received in streaming, through the QI Journal website, provided that the specifications listed in the guidelines for authors

Condições éticas a publicação de trabalhos

Considerando-se a necessidade de adequação às diretrizes sobre Ética e Integridade na Prática Científica, elaboradas segundo o Relatório da Comissão de Integridade de Pesquisa do Conselho Nacional de Desenvolvimento Científico e Tecnológico (CNPq), a Revista Quaestio Iuris, prezando pela qualidade e integridade de seus trabalhos, obedece aos seguintes princípios:

1: O autor deve sempre dar crédito a todas as fontes que fundamentam diretamente seu trabalho.

2: Toda citação in verbis de outro autor deve ser colocada entre aspas.

3: Quando se resume um texto alheio, o autor deve procurar reproduzir o significado exato das ideias ou fatos apresentados pelo autor original, que deve ser citado.

4: Quando em dúvida se um conceito ou fato é de conhecimento comum, não se deve deixar de fazer as citações adequadas.

5: Quando se submete um manuscrito para publicação contendo informações, conclusões ou dados que já foram disseminados de forma significativa (p.ex. apresentado em conferência, divulgado na internet), o autor deve indicar claramente aos editores e leitores a existência da divulgação prévia da informação.

6: se os resultados de um estudo único complexo podem ser apresentados como um todo coesivo, não é considerado ético que eles sejam fragmentados em manuscritos individuais.

7: Para evitar qualquer caracterização de autoplágio, o uso de textos e trabalhos anteriores do próprio autor deve ser assinalado, com as devidas referências e citações.

8: O autor deve assegurar-se da correção de cada citação e que cada citação na bibliografia corresponda a uma citação no texto do manuscrito. O autor deve dar crédito também aos autores que primeiro relataram a observação ou ideia que está sendo apresentada.

9: Quando estiver descrevendo o trabalho de outros, o autor não deve confiar em resumo secundário desse trabalho, o que pode levar a uma descrição falha do trabalho citado. Sempre que possível consultar a literatura original.

10: Se um autor tiver necessidade de citar uma fonte secundária (p.ex. uma revisão) para descrever o conteúdo de uma fonte primária (p. ex. um artigo empírico de um periódico), ele deve certificar-se da sua correção e sempre indicar a fonte original da informação que está sendo relatada.

11: A inclusão intencional de referências de relevância questionável com a finalidade de manipular fatores de impacto ou aumentar a probabilidade de aceitação do manuscrito é prática eticamente inaceitável.

12: Quando for necessário utilizar informações de outra fonte, o autor deve escrever de tal modo que fique claro aos leitores quais ideias são suas e quais são oriundas das fontes consultadas.

13: O autor tem a responsabilidade ética de relatar evidências que contrariem seu ponto de vista, sempre que existirem. Ademais, as evidências usadas em apoio a suas posições devem ser metodologicamente sólidas. Quando for necessário recorrer a estudos que apresentem deficiências metodológicas, estatísticas ou outras, tais defeitos devem ser claramente apontados aos leitores.

14: O autor tem a obrigação ética de relatar todos os aspectos do estudo que possam ser importantes para a reprodutibilidade independente de sua pesquisa.

15: Qualquer alteração dos resultados iniciais obtidos, como a eliminação de discrepâncias ou o uso de métodos estatísticos alternativos, deve ser claramente descrita junto com uma justificativa racional para o emprego de tais procedimentos.

16: A inclusão de autores no manuscrito deve ser discutida antes de começar a colaboração e deve se fundamentar em orientações já estabelecidas, tais como as do International Committee of Medical Journal Editors.

17: Somente as pessoas que emprestaram contribuição significativa ao trabalho merecem autoria em um manuscrito. Por contribuição significativa entende-se realização de experimentos, participação na elaboração do planejamento experimental, análise de resultados ou elaboração do corpo do manuscrito. Empréstimo de equipamentos, obtenção de financiamento ou supervisão geral, por si só não justificam a inclusão de novos autores, que devem ser objeto de agradecimento.

18: A colaboração entre docentes e estudantes deve seguir os mesmos critérios. Os supervisores devem cuidar para que não se incluam na autoria estudantes com pequena ou nenhuma contribuição nem excluir aqueles que efetivamente participaram do trabalho. Autoria fantasma em Ciência é eticamente inaceitável.

19: Todos os autores de um trabalho são responsáveis pela veracidade e idoneidade do trabalho, cabendo ao primeiro autor e ao autor correspondente responsabilidade integral, e aos demais autores responsabilidade pelas suas contribuições individuais.

20: Os autores devem ser capazes de descrever, quando solicitados, a sua contribuição pessoal ao trabalho.

21: Todo trabalho de pesquisa deve ser conduzido dentro de padrões éticos na sua execução, seja com animais ou com seres humanos.

Considering the need of adequacy to the guidelines on Ethics and Integrity in Scientific Practice, prepared in accordance with the Relatório da Comissão de Integridade de Pesquisa do Conselho Nacional de DesenvolvimentoCientífico e Tecnológico (CNPq), QuaestioIurisJournal, maintaining the quality and integrity of their work,obeys the following principles:

1: The author should always give credit to all sources that directly underlie their paper.

2: Every quote in verbisfromanother authormust be enclosed in quotation marks.

3: When it summarizes someone else's text, the author must attempt to emulate the exact same meaning of the ideas or facts presented by the original author, that should be mentioned.

4: When in doubt if a concept or fact is common knowledge, should not fail to make appropriate citations.

5: When you submit a manuscript for publication containing informations, conclusions or data that has been spread in a significantly way (for ex. presented at the conference, posted on the Internet), the author should clearly indicate to the editors and readers the existence of the prior disclosure.

6: If the results of a single complex study may be presented as a cohesive whole, it is not ethical that they are fragmented into individual manuscripts.

7: To avoid any characterization of self-plagiarism, the use of previous texts and words from the own author must be mared,with appropriate references and quotes.

8: The author must ensure the correction of each citation and that each citation in the bibliographycorresponds to a citation in the manuscript text. The author must also give credit to authors that first reported the observationor the idea that is been presented.

9: When you are describing the work of others, the author should not rely on secondary summary of this paper, what can lead to failure of that job description. Whenever it`s possible consult the original literature.

10: If an author has the need to quote a secondary source (for .ex. a review) to describe the contents of a primary source (for ex. an empirical article from a periodic), he must certify your correction and always indicate the original source ofthe information being reported.

11:The intentional inclusion of questionable relevance references in order to manipulate impact factors or increase the probability of acceptance of the manuscript is aethically unacceptable practice.

12: When it is necessary to use information from other sources, the author should write in such a way that make it clear to readers which ideas are theirand which come from the sources consulted.

13: The author has the ethical responsibility to report evidence that contrary their point of view, whenever there`s. Moreover,the evidences used to support your positionsshould be methodologically solids. When necessary use studies that showsmethodological deficiencies, statistics or others, such defects should be clearly pointed out to readers.

14: The author has the ethical responsibility to report alt the study aspects thatthat may be important for independent reproducibility of yoursearch.

15: Any change in the initial results obtained, as the elimination of discrepanciesor the use of alternative statistical methods, should be clearly described along with a rationale for the use of such procedures.

16: The inclusion of authors in the manuscript should be discussed before you start the collaborationand must be based on established orientations, such as the ones from International Committee of Medical Journal Editors.

17: Only people who have lent significant contribution to the work deserve authorship in a manuscript. A significant contribution means conducting experiments, participation in the development of the experimental design, Analysis of results or preparation of the manuscript body. Equipment loan, obtainment of financing or general supervision, by its own does not only justify the inclusion of new authors,that must be an object ofacknowledgment.

18: The collaboration between teachers and students should follow the same criteria. Supervisors must take care for not to include in the authorship with little or no contribution or exclude those who effectively participated in the work. Ghost authorship in science is ethically unacceptable.

19: All the authors of a work are responsible for the veracity and reliability of the work, fitting the first author and the corresponding author the full responsibility, and the other authors responsibility for their individual contributions.

20: Authors should be capable to describe, when requested, his personal contribution to the paper.

21: All research work should be conducted within ethical standards in their implementation, with animals or human beings.
