Abstract

This research aims to investigate, based on the observation of the 'Carrefour Case,' how the category of justice is mobilized by progressive groups in the context of rights violations. In this sense, the goal is to comprehend what is meant by seeking justice in cases such as the one analyzed, not only to pinpoint the role that resorting to criminal law as a means of combating impunity plays in the fight against racism but also to identify the inherent limitations of redressal in similar cases. Therefore, the adoption of the framework of modern penal rationality has been chosen, as it emerges as the most suitable theoretical reference for the punitive logic that underlies the Brazilian criminal justice system, allowing an understanding of how criminal law relates to the aspirations of progressive groups in their pursuit of justice. Accordingly, empirical research of a qualitative nature through a case study will be conducted.
