Resumo

O presente artigo tem como objetivo realizar um diagnóstico das representações do indígena através do estudo da invenção da categoria jurídica do “selvícola”. Para tanto o estudo se baseia na leitura e problematização da literatura jurídica brasileira da primeira metade do século XX sobre os indígenas, enfocando sobretudo autores que foram influências ou responsáveis diretos pela edição do decreto 5.484 de 1928, ato responsável pela modernização da tutela jurídica e por uma recolocação da questão indígena no pensamento jurídico. O curto estudo também busca compreender as relações entre o Estado brasileiro e os diversos povos indígenas pela mediação da linguagem jurídica durante o período de modernização do direito que permeia os anos 1920-1940.

Abstract

This article aims to make a diagnosis of the mental representations of the indigenous populations by studying the invention of a legal category called “selvícola” (inhabitant of the forest). Therefore the study is based on the reading and questioning as source the Brazilian legal literature of the first half of the twentieth century on indigenous, focusing especially authors who were influenced or directly responsible for the edition of the decree 5.484 of 1928, the legal document responsible for the modernization of legal protection and a replacement of the indigenous as “problem” in legal thought . The short study also seeks to understand the relationship between the Brazilian state, the territory and the various indigenous ethnies through the mediation of legal language during the period of modernization that permeates the years 1920-1940.
