A literatura sobre judicialização de políticas públicas e o caso da judicialização da previdência rural

O presente artigo busca relacionar a agenda de pesquisa sobre judicialização de políticas públicas e as características da judicialização da previdência rural. A partir da premissa de que a judicialização é uma experiência sem uma conotação valorativa a priori, comparo a propensão brasileira à litigância individual com o contexto de judicialização na América Latina. A experiência brasileira tanto de constitucionalização da política previdenciária quanto de criação de juizados especiais é indutora da multiplicação de litígios. A conclusão é a de que a judicialização da previdência rural se amolda apenas parcialmente ao que seria um possível “modelo brasileiro” de litigância em matéria de direitos socioeconômicos. Ainda que seja marcada por processos individuais, ela atinge segurados pobres e residentes em cidades do interior do país. Por isso, não lhe caem bem críticas formuladas a respeito, por exemplo, dos litígios em matéria de saúde quanto à apropriação dos recursos da justiça por indivíduos privilegiados e as condenações elevadas. Firmo, assim, como características da judicialização da previdência rural as suas singulares manifestações no campo do acesso à justiça, a possibilidade de conciliação e oralidade do procedimento e o valor baixo das condenações, elementos que deslocam a política pública da administração pública para o Poder Judiciário.
