A hipótese central do presente trabalho é a de que os mais recentes processos de transformação – sejam formais ou interpretativos – que a Constituição brasileira vem sofrendo nos últimos tempos estão intimamente relacionados com o encerramento de um ciclo político – democratizante – e a abertura de um novo ciclo – cujas feições ainda são incógnitas. Nessa linha, esse final de ciclo será relacionado com o exercício de algo que a literatura especializada tem chamado de “constitucionalismo abusivo”, associado com momentos nos quais a classe política usa os instrumentos constitucionais democráticos para tornar a constituição menos democrática. O resultado do apelo constante a esse constitucionalismo abusivo é um “desmembramento constitucional”, originado de uma tentativa deliberada de desfazer as fundações da Constituição de 1988.Downloads
